Fysiotherapie Braakhuis considers it important that your personal data and medical data are handled carefully, securely and confidentially. We process personal data in accordance with applicable laws and regulations, including the General Data Protection Regulation (GDPR) and the Medical Treatment Agreement Act (WGBO).

In this privacy statement we explain which personal data we process, why we do this, with whom data may be shared, how we secure it and what rights you have.

Fysiotherapie Braakhuis is the controller for the personal data we process in the context of our healthcare provision.

2. Which personal data do we process?

Which data we process depends on your contact with our practice and on the care we provide to you.

General personal data

We may process, among other things:

  • name and initials.
  • date of birth.
  • address details.
  • telephone number.
  • email address.
  • citizen service number (BSN).
  • data about your health insurance.
  • data necessary for administration and identification.

Health data

When you are under treatment with us, we process data that is necessary for good physiotherapeutic care. This may include, among other things:

  • your request for help and health complaints.
  • relevant medical history.
  • information about previous treatments.
  • examination data.
  • physiotherapeutic diagnosis.
  • treatment plan.
  • treatment data.
  • progress and evaluations.
  • relevant information about conditions or medication.
  • information you provide to us yourself that is relevant to your treatment.
Health data is a special category of personal data. We only process this data when there is a legal basis for doing so and when this is necessary for our care provision or to comply with legal obligations.

3. What do we use your personal data for?

We process your personal data insofar as this is necessary for:
  • providing physiotherapeutic care.
  • carrying out and recording your treatment.
  • maintaining your medical record.
  • planning and managing appointments.
  • sending appointment confirmations and other necessary communication.
  • processing questionnaires that are part of your treatment.
  • administrative processing.
  • invoicing and billing.
  • checking insurance data.
  • communication with your health insurer when this is necessary for billing or the provision of care.
  • complying with legal obligations.
  • handling complaints and disputes.
  • answering questions you ask via our website, email or telephone.
We do not process more personal data than is necessary for the relevant purpose.

4. Legal basis

We only process personal data when there is a legal basis for doing so.
For the provision of physiotherapeutic care, the processing of personal data and health data is necessary for the performance of the treatment agreement and for compliance with legal obligations.
Additional rules apply to health data because this is a special category of personal data. The processing takes place on the basis of the statutory exceptions that apply to the provision of care and the keeping of a medical record.
When your consent is required for a specific processing activity, we will ask for this separately.

5. Your medical record

When you are treated by us, we record the data necessary for your treatment in a medical record.
A physiotherapist, like other healthcare providers, keeps a medical record. This may include, among other things, your diagnosis, treatment, progress and relevant information that you provide yourself.
We use Fysiomanager for this purpose, an electronic patient record for physiotherapy.
Your medical record is handled carefully and confidentially. Only persons who are authorised to do so and who need access for their work can gain access to patient data.

6. Fysiomanager and MijnZorgtoegang

For our patient administration, record-keeping and various processes surrounding your treatment, we use Fysiomanager.
Through MyCareAccess, patients can, among other things, make appointments online and, when it’s part of the treatment, receive and fill out questionnaires.
MijnZorgtoegang is integrated with Fysiomanager. Completed questionnaires can therefore become directly available in the patient record.
Within our Fysiomanager package, we also use the available functionalities for, among other things, patient communication, policy verification and administrative processing.
Fysiomanager is provided by World of Health B.V. For the processing of personal data within the service, appropriate agreements on data processing and security apply. Fysiomanager states that it maintains data processing agreements for this purpose.
Fysiotherapie Braakhuis, as the healthcare provider, remains responsible for the processing of personal data within our own care provision.

7. Online appointments

Via the website you can make use of the option to make an appointment online.
When you click the button for online appointments, you are directed to the online environment of MijnZorgtoegang/Fysiomanager.
The personal data you provide there is processed within the context of the appointment and the care provision of Fysiotherapie Braakhuis.
The privacy and security measures of the relevant service also apply to the processing within this environment.

8. Questionnaires

When this is part of your treatment, we may send you questionnaires via MijnZorgtoegang.
The answers may contain health data. When this information is relevant to your treatment, the completed questionnaires may become part of your medical record.
Fysiomanager states that completed questionnaires from MijnZorgtoegang can be made directly available in the patient record.

9. Invoicing and health insurance

We process personal data that is necessary for the administrative handling of your treatment.
This may relate to, among other things:
  • your health insurer.
  • your insurance details.
  • treatment data necessary for billing.
  • invoice details.
  • payment details.
Invoicing and administrative processing take place, among other things, via Fysiomanager.
When your treatment is declared to your health insurer, the data necessary for this may be provided to the relevant health insurer or other party when this is necessary under laws and regulations.
We do not provide more data than is necessary for the relevant purpose.

10. Contact form and email

You can contact us via our website.
When you use the contact form, the data you fill in is sent to our business email address info@fysiotherapiebraakhuis.nl.
We use this data solely to answer your question or to contact you.
Please preferably do not use the general contact form and regular email to send extensive medical or other sensitive health information. For medical information we use the communication channels designated for this purpose within our practice.

11. Google Workspace

For business email we use Google Workspace, in which we use the email address info@fysiotherapiebraakhuis.nl.
Personal data that you share with us via email may therefore be processed within this business email environment.
We only use email insofar as this is appropriate for the relevant purpose. Additional secure communication channels may be used for exchanging medical information.

12. Disclosure to other healthcare providers

We do not simply share your medical data with other persons or organisations.
When it is necessary for your treatment to share relevant information with another healthcare provider, this is done in accordance with applicable legal rules. When your consent is required, we will ask for your consent.
There may be situations in which data may or must be provided without your consent because a legal obligation or legal exception exists for this.
We only provide data that is necessary for the relevant purpose.

13. Security

We take appropriate technical and organisational measures to protect your personal data and medical data against loss, unauthorised access, unauthorised use, alteration or disclosure.
Access to patient data is limited to persons who need this data for their work.
Our digital care environment uses systems that are specifically designed for the processing of care data. Fysiomanager has published information security certification according to NEN 7510 for the development, hosting and support of Fysiomanager and MijnZorgtoegang.

14. Retention period medical record

We retain your medical record in accordance with the statutory retention periods.
As a general rule, medical records are retained for at least 20 years from the last change in the record. Under certain circumstances, a record may be retained for longer.
Other personal data may have a different statutory retention period.

15. Your privacy rights

You have various rights with regard to your personal data and medical record.
You have the right to, among other things:
  • information about the processing of your personal data.
  • access to your medical record.
  • a copy of your record.
  • correction of factually incorrect data.
  • adding your own statement to your record.
  • under certain circumstances, destruction of (part of) your record.
  • restriction of certain processing activities.
  • objection to certain forms of processing when a legal right to do so exists.
Your right to erasure under the GDPR does not mean that medical data must always be deleted immediately. Statutory retention periods and specific rules apply to medical records.

16. Children and young people

Specific rules from the WGBO apply to the treatment of minors. Which consent is necessary depends, among other things, on the age of the patient.
We treat minor patients in accordance with the applicable legal rules and handle their privacy and that of their parents or legal representatives with care.

17. Cookies and similar techniques

Our website may use cookies and similar techniques.
Cookies that are necessary for the functioning of the website may be used without consent when they meet the conditions applicable to this.
For analytical or tracking techniques for which consent is required, we ask for consent in advance.
We will not place tracking cookies based solely on visiting or further using the website. The Dutch Data Protection Authority requires prior information and consent for tracking cookies.

18. Social media

Fysiotherapie Braakhuis may use Facebook, Instagram and LinkedIn.
Our website may contain links to these social media channels. When you click on such a link, you leave our website and the privacy terms of the relevant social media platform apply.
We do not place patient data, photos or other information traceable to patients on our website without an appropriate legal basis and, when required, consent.

19. No automated decision-making

Fysiotherapie Braakhuis does not make decisions about patients that are based solely on automated processing and that have legal or similarly significant consequences for you.

20. Privacy complaints

Do you have a question or complaint about the way we handle your personal data? Please contact us first.
We will try to resolve your question or complaint together with you.
You also have the right to file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) if you believe that your personal data is not being processed in accordance with privacy legislation.

We may amend this privacy statement when our working methods or applicable laws and regulations change.
